In January 2002, the client had an accident in the Oval Basin in Cardiff Bay. This was caused by wooden flooring in a public, outdoor area that became slippery and very dangerous when wet. There had been previous complaints about this but no action had been taken by the City Council to replace the flooring with something safer or to take measures to warn the public of the hazard.
The accident caused serious injuries to the client's hand, thumb and arm, including a fractured elbow. As a result the client’s ability to work was affected for a considerable period and she endured a great deal of pain and suffering.
