Initial Advice
An advisor will take details of your potential
personal injury claim and these will be assessed by a specialist
personal injury lawyer, who will contact you to discuss the matter and provide legal advice.
A claim is made
If we believe your case has reasonable prospects of success, your lawyer will
make a claim against the party responsible for your accident or work related condition (for example your employer in an
accident at work, or another driver in a
road accident).
A letter of claim will be sent to their insurers, detailing your injuries and how the defendant was at fault. A schedule of any other losses related to your injury (loss of earnings, costs for transport, medication, etc) will also be drawn up as these can be recovered as part of the claim. In some cases, you will be examined by a medical expert for a full assessment of your injuries. This will help to ensure that your case is settled for the right amount.
Liability is Admitted
In many cases, the other side will accept responsibility for what happened, based on the evidence we put forward.
Negotiations will then be made between their insurers and your lawyer to agree upon a suitable amount of compensation. If an agreement can be reached, you will then be awarded your compensation and the other side will also pay your legal costs.
If liability is admitted but the parties cannot agree on how much compensation you should receive, court proceedings may be issued and your case may be taken to court for a Judge to decide.

Liability is Denied
Sometimes, the other side will dispute that they are responsible for your accident. If no agreement can be made, your case will proceed to court, so long as we are satisfied that there are reasonable prospects of your case succeeding.
