Bus Driver Compensated for Back Injury and Hearing Loss

11th April 2011

Our expert personal injury lawyers recently made a successful claim on behalf of a bus driver, who suffered hearing damage and a back injury due to an accident at work, caused by malfunctioning equipment.

Injured at Work

At the time of his accident our client was driving a bus, sitting in the driver’s seat within an enclosed security cubicle. Suddenly, an air cushion beneath the seat exploded without warning and he suffered a personal injury.

The explosion was very loud and the driver was immediately aware that he could not hear properly and there was a ringing in his ears. It also caused his seat to collapse and this resulted in a back injury.

Long-term Injuries

Our client had to take 3 months off work to help with his recovery and underwent a course of physiotherapy to treat the injury to his back. Unfortunately however he did not recover fully and he has been left unable to play golf, visit the gym, lift anything heavy or sit for long periods.

The problems with our client’s hearing are also ongoing. Although one ear improved soon after the accident, he was left with substantial noise-induced hearing loss and tinnitus affecting the other ear. This affects his ability to hear conversations and therefore makes it more difficult for him to work and socialise.

As a result of his injuries, our client lost his job with the bus company and had to seek alternative employment. He also now requires a hearing aid on a permanent basis.

Faulty Work Equipment

The injured bus driver appointed our lawyers, who are specialists in workplace accident cases, to assist him in pursuing an injury claim against his employer. He felt that they were responsible for the accident because they provided faulty work equipment.

The defendants admitted liability for what happened, however they did not put forward a suitable offer of compensation. We issued court proceedings, but through negotiations with the other side we were able to secure £17,000 in damages for our client before the case went to trial. It was necessary for us to reject initial offers before this sum was obtained, which highlights the importance of using a specialist lawyer for any personal injury claim.
