Compensation Claim for Bus Passenger

Our specialist personal injury lawyers recently recovered compensation for a bus passenger, who was injured due to the negligent actions of a bus driver.

Passenger Injury

At the time of her accident, the claimant was the only passenger on a bus. She was sitting in the first row of seats behind the driver and had a clear view of the road ahead.

She observed that the driver was travelling very closely behind the vehicle in front and not taking sufficient care. Suddenly he braked forcefully and the claimant was thrown out of her seat, over a distance of eight feet, and into an upholstered pillar.

The driver contacted the control room by radio to report the incident, whilst the claimant lay on the floor of the bus. At this time he told them he had to apply the brakes heavily to avoid a collision with the car in front.

Personal Injury Claim

The claimant appointed our expert lawyers to assist her in making a personal injury claim for compensation.

Initially, the bus company denied responsibility for this passenger injury, on the grounds that the driver braked so suddenly to avoid a pedestrian who walked into his path.

Evidence given by the claimant was that there had been no pedestrian in the road. She alleged that the driver failed to slow down in a controlled manner, thereby taking insufficient measures to ensure the safety of his passengers.

When the case went to trial, the bus company’s report log was disclosed. This supported the version of events outlined by the claimant, with no mention of a pedestrian. As the driver was also unable to describe the pedestrian and could not remember what he said when reporting the accident, the Judge found in the claimant’s favour.

She was awarded £2,602.00 compensation in respect of her injuries and losses.
