Our client underwent an operation to remove her gall bladder in 2000 at Birch Hill Hospital. This should have been a routine procedure but a mistake by the surgeon caused damage to her common bile duct. This resulted in a great deal of unnecessary pain and suffering to her with the additional risk of health problems in the future.
All the claimant wanted was for the hospital to admit their mistake and offer an apology. Initially she pursued a complaint through the National Health Service but the hospital trust were unwilling to admit that a surgical error had been the cause of the problem.
During this process it was suggested to the client that the complication was simply “one of those things”, or even that it had happened because she “was fat”. At this point it became clear to her that the matter would not come to a satisfactory conclusion via this route. We issued proceedings against the Pennine Acute Hospitals NHS Trust, who are responsible for Birch Hill Hospital.
The Hospital Trust’s solicitors were unable to produce any expert evidence to refute the client’s own evidence that the complications she suffered were a result of a surgical error. Therefore the claim was settled shortly before the planned trial date and our client was awarded compensation of £30,000.
