A healthcare worker suffered a fall at work because her workplace was not sufficiently safe. She injured her arm as a result and our specialist personal injury solicitors acted on her behalf in a compensation claim.
Our client was walking out to her car when her personal injury occurred. There had been harsh weather for several weeks, with a lot of ice and snow, however the car park had not been gritted or treated. The surface was therefore covered with ice.
She was wearing sensible footwear because of the conditions, but the car park was simply too slippery and she fell, landing heavily onto her arm. Our client suffered injuries to her elbow and shoulder, including a nasty wound that required stitches. There was a lot of bruising and swelling and the movement in her shoulder was restricted.
Because of her accident at work, our client could not drive for a number of weeks and could not go back to work for several months. Her family had to help her with her day-to-day activities during her recovery and she needed physiotherapy. Her shoulder in particular continued to be a problem long-term.
There had been 2 previous accidents on the car park in similar circumstances in the week leading up to our client’s fall. They were both reported, however it was not made safe. She therefore felt that her accident could have been avoided and approached us for help with a personal injury claim.
The other side denied that they were responsible for the accident. They said that they gritted the car park regularly, but were unable to provide any evidence of this. They also said that our client should have used a different exit, but there were no signs to this effect and it was standard practice for staff to exit where she did.
We negotiated with the other side and secured a settlement of over £9,500 in damages for our client after rejecting an initial, lower offer. This sum took into account the injuries she sustained and also her financial losses, including her loss of earnings, care costs and travel expenses related to the injury.
