Our specialist personal injury lawyers recently acted for a man who suffered a foot injury because of an accident at work. The claim was successful and he received compensation.
At the time of his accident, our client was working with 2 colleagues to lower a large object to the ground, using an overhead crane. One of his colleagues was operating the crane, while he and the other member of staff guided the load. He was fully trained for the work and wearing the steel toe cap boots provided by his employer.
During the job, a counterweight fell from the crane because a bolt holding it in place came free. It landed on our client’s foot and fractured one of the main bones.
Because of his workplace accident, our client was unable to attend work for 5 months and he could not drive or play sports until he was recovered. He spent a number of weeks in a plaster cast and then had to have physiotherapy to help him regain the use of his injured foot.
The injured fitter asked us for help with a personal injury claim, as his accident could have been avoided if he was provided with safe equipment. The incident occurred because the crane was not properly maintained.
We began a compensation claim on his behalf and the other side admitted liability, but they did not put forward any offers of compensation so we began court proceedings. We were able to negotiate a settlement with them before the case went to trial however. After rejecting an initial, lower offer, we secured £10,000 in damages for our client in respect of his personal injury, loss of earnings and other costs he incurred because of his accident.
If you have suffered an injury due to an industrial accident, or any other accident caused by someone else’s negligence, you may be entitled to make an injury claim.
