Council Employee Receives Vibration White Finger Compensation

24th October 2012

In a recent case, our industrial disease team secured compensation for a man suffering from hand arm vibration syndrome (or HAVS, also commonly known as vibration white finger).

Exposed to Excessive Vibration at Work

Our client was a construction worker for a local authority. As a regular part of his job he used vibrating equipment including hydraulic breakers, stihl saws, grinders and whacking plates. He was never told to limit his time on these tools and was not warned of the health risks of prolonged exposure to vibration.

He began to suffer tingling and numbness in the fingers of both hands and found that he was having difficulty handling small objects and performing more fiddly tasks. He sought medical attention and was diagnosed with HAVS.

Only in his 40s, our client’s condition is not reversible and he will be permanently restricted in the work he can do, as he is no longer able to use vibrating tools at all.

Employer Admitted Putting Worker at Risk

We acted on behalf of the injured employee in a personal injury claim. After we put forward evidence of his exposure to vibration at work and the harm this caused, his employer admitted that they were at fault.

After rejecting an initial, lower offer, we were able to negotiate a settlement of £20,000 compensation for our client.
