Asbestos Victim Receives £37,500 Compensation

Asbestos Related Disease

The claimant was employed as a caretaker for a number of years and had to work in a boiler house on a regular basis. This would involve cleaning and maintaining the boiler and pipes, which were covered with asbestos lagging, and brushing up asbestos dust from in the room when the lagging was damaged.

He was also present when the boiler and pipes were dismantled and removed by contractors before they were replaced. Over a period of several weeks he helped to clear up after the contractors, which involved sweeping away and working around large amounts of asbestos dust. There were no health and safety measures in place for this work and the claimant was not provided with any personal protective equipment.

After he retired he began to suffer problems with his chest and difficulty breathing, so sought medical advice. He was diagnosed with pleural thickening, a condition which restricts his lifestyle in that he can no longer walk any distance, struggles with stairs and cannot perform physical tasks such as housework, DIY or carrying shopping.

Industrial Disease Claim

The claimant instructed our expert personal injury lawyers to make an industrial disease claim against his former employer on his behalf.

They were able to recover damages of £37,500 in respect of the pain, worry and incapacity caused by his illness and also for services he now requires for duties he can no longer carry out himself.
