We recently secured compensation for a woman who was injured because of a dangerous cattle grid on a country road.
Our client was out cycling when she came to a cattle grid. She slowed to a steady pace and began to cross it, but her front wheel dropped into a gap in the bars. This caused her to come to a sudden stop and she was thrown from her bicycle.
Cattle grids usually have bars that run all the way across, however this one had bars that were in sections with gaps in between, making it hazardous to cyclists.
As a result of the accident, our client suffered injuries to her neck, back, shoulder and chest. There was also bruising and grazing to her face and a deep wound on one of her fingers that had to be stitched at hospital. Her back injury persisted for over a year and she was left with long-term problems with her hand and some scarring.
In addition to her personal injury, our client incurred expenses because of the accident. Her bicycle and clothing were damaged and she had to cover the costs of wound dressings, medication, physiotherapy and travel to appointments.
We acted on behalf of the injured cyclist in a compensation claim against the Council responsible for the road. We showed evidence of our client’s injuries and the unsafe cattle grid and the Council admitted responsibility for the accident.
Although they put forward offers of compensation, these were not reasonable given the level of injury, so we advised our client to reject them and began Court proceedings. We were able to negotiate a suitable settlement before the case went to trial however and our client received £10,000 in damages.
