We recently represented an employee who suffered an accident at work when a faulty chair collapsed underneath him. He received compensation for injuries to his hip, back and teeth.
Our client was sitting on a swivel chair whilst using a computer. One of the legs suddenly sheared off the chair and it collapsed, causing him to fall backwards to the floor.
He injured his hip and lower back and also damaged his teeth. He needed physiotherapy and dental treatment and was unable to work for almost 2 months. He also had to give up some of his hobbies due to ongoing problems.
The injured employee approached our specialist solicitors for help with a personal injury claim. He felt that if his employer provided a safe chair in a good state of repair his accident could have been avoided.
Employers have a strict responsibility under the PUWER (Provision and Use of Work Equipment) Regulations to provide safe and suitable equipment. We pursued a case against our client’s employer on the basis that they failed to do this and they admitted liability. Although they put forward an offer of compensation this was not reasonable and they did not make any further offer. We therefore had to commence Court proceedings, however we were able to negotiate an appropriate settlement for our client before the case went to trial. He received £4,500.
