An employee who was not provided with the correct equipment to do his job safely suffered a hernia in an accident at work. Our expert personal injury lawyers acted on his behalf in a successful compensation claim.
As part of his job our client used a machine to finish large, metal parts. The machine was out of order however, so on the day of the accident he and a colleague were working in a different room using another machine instead. The parts were beside the machine in baskets and ordinarily air-powered scissor lifts would be used to raise them to work height. No provision had been made for them to have scissor lifts in the alternative room though, so our client had to lift parts manually from just above floor level.
When he lifted one of the parts, he felt pain in his groin. A lump developed and he saw his doctor, who diagnosed a hernia. Our client had to have surgery to repair the hernia and was unable to attend work for 5 weeks. He could not return to his normal duties until 2 months after the operation, but thankfully he eventually made a full recovery from his personal injury.
Our client felt that his employer was responsible for his manual handling accident, as they did not take reasonable measures to prevent him from being injured. He therefore appointed our solicitors to make a personal injury claim on his behalf.
We began a claim and the other side admitted liability for the accident. We put forward medical evidence of our client’s injuries in order to negotiate a compensation settlement and secured £4,500, which included an amount for his loss of earnings.
