Our specialist personal injury lawyers recently assisted a man who suffered injuries in an accident at work because he was provided with faulty equipment. We made a successful compensation claim against his employer on his behalf.
The claimant was working at height when his accident occurred. He used the extendable ladders provided to access a ceiling space and was making his way back down when he felt them collapse beneath him. This happened because part of the ladders buckled, due to a fault.
Our client fell to the floor from a height of around 10 feet and sustained injuries to his head, neck and shoulder, including nerve damage. He was unable to work for a month and had to have physiotherapy and injections to treat his injuries. Although he was able to return to work, he experienced some long-term effects.
We represented the injured man in a personal injury claim against his employer, as they failed to supply safe and suitable equipment.
The defendants alleged that our client was partly responsible for the accident, stating that he should have used alternative means of accessing the ceiling. The ladders would have been suitable if they were in good condition however, and there was no other equipment that he could have used.
Using our expert knowledge of the law relating to work equipment and working at height we were able to prove that our client was not to blame and his employer eventually admitted full liability. We obtained medical evidence of our client’s injuries and negotiated with the other side with regard to an appropriate settlement of compensation. He received £12,750 in respect of his personal injury, loss of earnings, and other expenses resulting from the accident.
