A man who suffered a fall at work due to a tripping hazard was represented by our expert personal injury lawyers in a successful compensation claim against his employer.
Our client was employed by a motor vehicle manufacturer at the time of his workplace accident. He was walking across a section of the factory where a thick, plastic film had been attached to the floor to protect it from paint. Over time the film had become damaged, and had bunched up in places, however it had not been replaced or re-laid. This caused our client to trip and fall and he landed heavily on his knee.
The claimant suffered a significant knee injury as a result of the fall. He underwent hospital treatment, including physiotherapy, and took some time off work to aid his recovery, however there was little improvement. He was advised that his condition will probably deteriorate over time, possibly to the point where he will become disabled. He will most likely require surgery in the future and there is a strong possibility he will develop arthritis in the joint.
The injured employee decided to pursue a personal injury claim, as he felt his employer failed to provide him with a safe workplace. He appointed our specialist lawyers to deal with the case on his behalf.
We pursued the claim and the company admitted liability for the accident. We entered into negotiations with them and secured £40,000 compensation for our client. This sum was in respect of the pain and ongoing symptoms of the injury, our client’s related out of pocket expenses and also his loss of earnings, taking into account the potential loss of future earnings as his condition progresses.
