A man suffered multiple injuries in an accident at work because of faulty machinery. We acted on his behalf in a compensation claim against his employer.
Whilst operating a packing machine our client noticed that it was not functioning properly. It was part of his job to investigate why, so he opened the safety gate and went to take a look. Opening the safety gate should have cut the power to the machine, however when he leaned over it part of the mechanism came down onto his back with force. Investigations carried out after the accident showed that the safety gate had been deactivated during some earlier maintenance work.
Our client suffered deep wounds to his back, a fractured rib, leg injuries and facial injuries. He required hospital treatment and could not attend work for a number of weeks. It was around 4 months before he was fully recovered and he was left with scarring from the wounds on his back.
The injured employee appointed our specialist solicitors to assist him in a personal injury claim. Employers have a strict responsibility to provide work equipment that is safe and suitable, so we began a case against our client’s employer on the basis that they failed to do this.
We had to begin court proceedings because the other side did not put forward any offers of compensation. We were able to negotiate a settlement before the case went to trial however, and our client received damages.
