Our specialist personal injury lawyers recently acted on behalf of an employee who suffered two accidents at work because heavy boxes were marked with incorrect weight labels. He received compensation for injuries to his back.
In the course of his work as a delivery driver, our client often had to lift and carry large items. It was important for these items to be clearly marked with their weight, so that they could be handled in the correct manner to avoid personal injury. Unfortunately however, on 2 occasions he was given packages that were marked with much lower weights than they actually contained.
When he tried to lift these packages he suffered back injuries. After both accidents he inspected the packages to find that the labels from the manufacturers showed much heavier weights than those affixed by his employer.
He had to take 3 months off work to recover from the first accident and then a further 2 months off after the second accident. This meant that he incurred a loss of earnings.
Our client’s employer failed to make sure that proper measures were taken to protect his safety. If the packages had been marked correctly his manual handling accidents would not have occurred. He therefore appointed our lawyers to pursue a personal injury claim on his behalf.
We put forward evidence of what happened to the other side, including the package labels and medical reports of our client’s injuries, and they admitted liability. Their first offer of compensation was very low in light of the damage caused, so we negotiated for an increased offer and our client received £10,000. This sum included an amount for his lost earnings and the costs of medication and travel to medical appointments.
