Council Worker Receives Damages for Neck Injury

Injured at Work

The claimant was attempting to lift a wardrobe up a set of stairs with his colleague, when the wardrobe collapsed onto his neck.  It was a triple wardrobe, which was four to five feet wide and over six feet tall.  It was a heavy item.

Normally, the claimant worked on glass collection and he had received no official training for working on the collection of bulky items.  He had only worked on this type of collection a few times in the past and it was not his usual job.  He was not instructed to carry out a risk assessment of the situation presented before him and was not advised of any procedure / protocol for dealing with heavy items in awkward spaces.

Although a sack barrow had been provided, this was unsuitable for moving the wardrobe up the stairs and the item had been left in the person's back garden, as opposed to the front boundary as ordered on the original work sheet.  As a result of the accident our client suffered lacerations and a strain to his neck.

Personal Injury Claim

Our lawyers were appointed to assist the injured employee in making a personal injury claim in respect of this accident at work.  The Defendants denied liability throughout the case and, in fact, never confirmed their position on liability.

We obtained medical evidence and disclosed this to the claimant's employer, with a view to commencing court proceedings.  They then made an offer of settlement and, through negotiations, we were able to secure a suitable amount of personal injury compensation on our client's behalf.

In a letter of thanks to his lawyer he wrote: 'Thank you for all your hard work with my case, you are a credit to your company.'
