Lawyers Suggest Insurance Industry Provides Misinformation on Personal Injury Claims

2nd April 2008

Ahead of the expected publication of the government’s response to the personal injury claims process consultation, our lawyers, Thompsons Solicitors, have warned that the ABI (Association of British Insurers) is involved in a misinformation campaign.

Personal Injury Claim Costs

The ABI has complained about the costs involved in personal injury cases. However it fails to admit that the actions of its members, such as delays in responding to claims, often add to these costs, Thompsons says.

Thompsons’ director of policy and public affairs, Tom Jones, commented: “Our experience is that delay and costs build up are substantially down to insurers and employers. The ABI continue to claim for example that disproportionate costs are down to claimants and yet they repeatedly fail to win court challenges to costs claimed at the end of cases.”

Compensation Claims

Relying on research that has been discredited by an independent expert, the ABI also incorrectly suggests that injured people receive more compensation if they are not represented by a lawyer.

Our lawyers, the most experienced personal injury firm in the UK, have therefore written to Labour members to raise the issue of misinformation provided by the ABI, in the interests of claimants.
