A council employee suffered a personal injury in an accident at work when she was given an unsuitable trolley to use. Our specialist lawyers acted on her behalf in a compensation claim.
Whilst working at a polling station, our client had to take a ballot box and some other items to another building. She was given a trolley to use for the purpose and it was necessary to pull the trolley along an outdoor, tarmac path.
The path was not in good condition and this made the trolley hard to control. What made the problem worse was that the handle was also very short and could not be extended, so pulling it was difficult. The trolley bounced on the surface and tipped from side to side. It came into contact with her leg and caused her to fall, as a result of which she suffered a fractured elbow. It took some time for this injury to heal, which caused her significant problems with her day to day activities and she had to take time off work.
The claimant felt that her injury was caused by her employer, as they did not provide her with equipment that was suitably safe and fit for purpose. Our client’s employer denied that they were responsible for the accident, as the trolley was sold as a ‘ballot trolley’. We took the case to court and the Judge took the view that, although the trolley was suitable for indoor use on a flat surface, it was not suitable for use on uneven surfaces, particularly for taller persons such as our client. The risk assessment her employer carried out also only dealt with the use of the trolley indoors. He therefore found in her favour and she was awarded compensation.
