An employee suffered an eye injury in an accident at work caused by a faulty piece of equipment, which was further complicated by sub-standard medical treatment. Our specialist personal injury lawyers recovered compensation on his behalf in a recent injury claim.
Our client was carrying out an inspection of some breathing apparatus at work at the time of his accident. He had been fully trained on the use and inspection of the equipment. Unfortunately however there was a fault with an oxygen cylinder valve and a blast of highly pressurised air was discharged into his eye as a result.
He was immediately in a great deal of pain and attended an on-site medical centre to be examined. He was later treated at hospital as the incident brought on a cataract.
Our client underwent a number of operations in an attempt to improve his vision and reduce the pain and discomfort. He did not recover well however and there were complications, which it transpired were caused by a piece of a medical instrument that had been left inside his eye and went unnoticed for a long period.
He was left with ongoing problems with his vision, affecting his ability to judge distances, read, work in the same capacity as before or carry out household tasks such as DIY and gardening. His personal injury also presents difficulties with hobbies he previously enjoyed and affected him psychologically.
The claimant felt his employer was responsible for his workplace accident as they supplied faulty equipment, and that the clinical negligence during his hospital treatment caused him a further injury. He appointed our lawyers, who have extensive experience in work related personal injury claims and medical negligence cases, to pursue a compensation claim on his behalf.
We were able to recover damages in the amount of £40,000 from his employer and £50,000 from the hospital Trust. This took into account the pain and suffering of the injury, loss of vision and loss of amenity, together with financial losses our client suffered including his loss of earnings.
