An ambulance technician injured at work due to the actions of his colleague recovered compensation recently, with help from our specialist personal injury lawyers.
Our client was attending to a patient in the rear of an ambulance, on the way to hospital after responding to an emergency call. Unfortunately, the driver of the ambulance drove very erratically and at too high a speed throughout the journey and, despite requests from our client, did not slow down or attempt to drive more smoothly.
The vehicle struck a kerb and the claimant was thrown backwards as the ambulance swayed violently. He landed awkwardly against a chair and suffered a back injury. The impact was so forceful that the patient was even jolted out of the trolley.
The injury prevented our client from returning to his previous occupation and he required months of treatment. He was left with long term problems with his back.
Our client felt that his employer was vicariously liable for the negligent actions of his colleague and instructed our lawyers to assist him in making a personal injury claim.
It was necessary to commence court proceedings as the claimant’s employer initially refused to negotiate a settlement of damages. It was eventually found that the driver had a duty to maintain a reasonable level of care for passengers, even in emergent situations, and that this had not been the case. The claim was therefore successful and our client was awarded £15,000 compensation.
