In a recent industrial disease case, our specialist personal injury lawyers acted on behalf of a man suffering from asbestosis and recovered compensation on his behalf.
Our client was employed as a fitter for most of his working life. For over 30 years he worked in the rail industry at Eastleigh Locomotive Works and through this he was exposed to large quantities of asbestos. Whilst building locomotive engines he worked in close proximity to laggers mixing and applying powdered asbestos, and when refitting or repairing engines he would often have to remove old asbestos lagging himself.
The work was very dusty, however the asbestos was never dampened down to prevent it from filling the atmosphere, our client was not provided with protective masks and there were no adequate extraction or ventilation systems.
After he retired, our client was diagnosed with asbestosis. This is an incurable asbestos-related disease affecting the lungs, caused by the inhalation of asbestos fibres, which causes shortness of breath, coughing and tightness and pain in the chest.
His condition affects his day to day life, as his physical activity is restricted. It has also left him unable to have a knee operation he requires because he is no longer a candidate for surgery.
