Compensation Claim for Victim of Assault at Work

An employee injured at work when he was assaulted by a patient with a history of aggression recovered compensation with help from our expert personal injury lawyers.

Insufficient Staffing

Our client was employed in a medium secure unit, caring for patients with learning disabilities. There were eight patients in the unit with four members of staff, however the nurse in charge on the day of the incident allowed three of the staff to leave with three patients, thus leaving the claimant and nurse in charge alone with five patients.

After only five minutes or so, one of the patients assaulted the claimant, gouging his face and attempting to bite off his thumb.

Personal Injury Claim

The claimant felt that his employer was responsible for this assault at work, so instructed our lawyers, who are experts in workplace injury cases, to assist him in making a personal injury claim.

He believed that the patient had a history of violence and aggressive behaviour and had previously heard him threaten to kill another member of staff, so felt his health and safety should have been protected by ensuring that sufficient staff were present.

The NHS Trust initially denied responsibility and our lawyers issued proceedings, however they eventually offered to settle the claim and paid compensation to our client.
