A bus passenger who suffered a fractured elbow and leg injury due to driver negligence recovered compensation recently, in a case handled by our specialist personal injury lawyers.
Our client boarded a ‘bendy’ bus at the middle set of doors. Within seconds the driver pulled off at speed, before she had chance to take her seat, then braked sharply. She was thrown forwards to the front of the bus and suffered a fracture to her elbow and strain injury to her leg.
It was necessary for the claimant to undergo surgery to repair the damage to her arm and a second operation will be required in the future to take out the metalwork currently in place. During her recovery she required a lot of assistance from family members and could not go about her usual activities.
The injured passenger felt that the bus driver acted irresponsibly and enlisted the help of our lawyers, who specialise in road accident cases, to assist her in making a personal injury claim.
The bus company initially denied liability, however the police report of the incident confirmed our client’s version of events and also outlined that there was already a vehicle overtaking the bus when the driver pulled off, which was why he had to brake so suddenly. They subsequently admitted liability and made an offer of compensation, but this did not reflect the extent of the claimant’s injuries. Following some negotiations, we were eventually able to secure £13,000 in damages.
