Successful Medical Misdiagnosis Compensation Claim

Our specialist clinical negligence lawyers recently acted for a man who developed long term shoulder problems as the result of a misdiagnosis.

Personal Injury

Whilst playing football, the claimant sustained a shoulder injury and attended hospital. Some x-rays were taken and he was told the following day that there was a fracture, so his arm was put into a sling. He was signed off from work and told to gently move the affected shoulder.

Over the following months he attended numerous appointments and was told that he was healing well, despite the fact that he complained of severe pain.

Injury Misdiagnosed

As physiotherapy did not help, the claimant eventually underwent further examinations and procedures around 6 months after the injury occurred.

It was not until several more months had passed that the cause of his problems was finally diagnosed. The claimant was told that his shoulder had originally been dislocated, and that this should have been noticed on the initial x-ray. The extended period without appropriate treatment had caused it to heal incorrectly.

He was left with permanently restricted movement in his shoulder and ongoing pain and, although he was able to re-train and take a different role, the claimant could not continue with his previous job as a train driver, which he enjoyed. He therefore appointed our lawyers to assist him in claiming compensation.

The claimant was awarded £45,000 damages in respect of his personal injury, loss of amenity and financial losses.
