Our specialist lawyers recently acted on behalf of the husband of an elderly woman, who tragically died due to clinical negligence. We recovered compensation on his behalf in a claim against the hospital Trust.
Our client’s wife underwent an operation, during which her uterus and bowel were accidentally perforated due to a surgical error. She developed peritonitis as a result of this, the symptoms of which unfortunately went unnoticed by the hospital staff.
Sadly, she passed away due to the delays in diagnosing her condition a short time after the operation.
We were appointed by the family of the deceased to assist them in making a claim against the NHS Trust, as our lawyers have a wealth of experience in medical negligence cases, including those involving fatalities.
Unfortunately, the scope for recovering compensation in respect of the loss of a loved one is quite restricted if the deceased did not survive for a long time after the injury, they did not leave behind relatives dependent upon them financially, or they otherwise had a limited life expectancy.
The Trust admitted negligence in failing to diagnose the perforation and peritonitis and we recovered £15,500 in damages, which included the statutory bereavement award and a sum to cover funeral expenses.
We were able to settle the case in a short time of our involvement, without the need for our client to go through court proceedings.
