Clinical Negligence Compensation for Discharged Soldier

21st December 2006

An Army solider, whose career was ended following an injury caused by a surgical error, has been awarded £190,000 damages with help from our specialist solicitors.

Surgical Error

John Thompson was a Signals Sergeant and dislocated his shoulder whilst playing rugby for the Army in February 1999. He suffered ongoing pain in the shoulder, so underwent an operation in January 2001 to help repair the damage.

The surgery was carried out by Commander Hill, an Army surgeon. Unfortunately, during the procedure he accidentally divided Mr Thompson’s biceps tendon. Because of this his shoulder continued to be problematic and another operation was necessary. This did little to improve Mr Thompson’s condition.

In May 2003 he was medically discharged from the Army as he was considered to have a permanent disability, thus ending his promising career. Prior to his injury Mr Thompson had an outstanding record and was regarded as having the potential to make good progress through the ranks.

Medical Negligence Compensation Claim

Mr Thompson not only suffered a personal injury due to the surgical error, but also a loss of earnings, pension and earning capacity for the future. He therefore instructed our lawyers to assist him in making a medical negligence claim for compensation.

The claim was successful and he was awarded compensation in respect of his injury and losses.
