In a recent case we obtained compensation for a man who suffered a personal injury in a car accident, which occurred due to farm waste on the road surface.
Our client was driving along a road and rounded a blind bend. As he did so he drove through a large amount of manure and mud that had been dropped by a vehicle from a nearby farm. This caused him to lose control of his car, which skidded off the road and overturned, landing upside down.
A member of the public called the emergency services to the scene as our client was unconscious in his car after the road accident. He was taken to hospital, where he received treatment for a badly fractured wrist, knee injury and ankle injury. Despite undergoing physiotherapy he was left with long term problems with his injured wrist and ankle and also suffered an acute stress reaction from the trauma of the incident, causing him to experience travel phobia. In addition there was extensive damage to his vehicle and he incurred costs for travel expenses and prescriptions during his recovery.

The defendant was not willing to accept full liability for the accident at first, even though our client was not exceeding the speed limit, he could not have seen the hazard on the blind bend and there were no warning signs to alert him to it.
They eventually put forward an initial offer of compensation, but this did not reflect the extent of our client’s injuries and the inconvenience and expense the incident caused him. We therefore rejected the offers and it was necessary to commence court proceedings. Before the case went to trial however, we were able to negotiate a settlement of £20,500 in damages on the claimant’s behalf.
