Our lawyers recently made a successful compensation claim on behalf of a woman who was injured at work and subsequently had to give up her job as a health care assistant.
At the time of her injury, the claimant was responding to an emergency buzzer on a high dependency unit. One of the patients had become confused and aggressive, which is a known side effect of the operation he had undergone, and was trying to get out of bed despite still being catheterised and under the effects of an epidural.
She and some colleagues were trying to assist him back into bed so that he did not hurt himself, however they were not provided with a safe system of work for doing so and there had been no risk assessment following previous, similar occurrences.
The patient grabbed and twisted the claimant’s wrists as she tried to prevent him from falling and she suffered injuries. Our client required surgery and physiotherapy, but there was some permanent damage and she could not return to her job. She also has difficulty with many other tasks, such as preparing meals or carrying larger items.
The claimant felt that her employers were responsible for the incident, as they did not ensure that there were sufficient measures in place to protect the health and safety of their employees.
She appointed our expert personal injury lawyers, who have extensive experience of such cases, to assist her in making a claim against her employer. They recovered £60,000 damages in respect of her injury, loss of earnings and other losses related to the incident.
