In a recent case our specialist personal injury lawyers recovered compensation for a machine assistant, Neil Anderson, who was injured in an accident at work.
Mr Anderson was wheeling a piece of machinery, a conveyor, into place at the time of his accident. The floor beneath the machinery consisted of metal plates and there was a gap between two of them in which one of the wheels became stuck. The conveyor stopped so suddenly that he suffered a back injury as a result.
The injury was such that our client required time off from work and, when he returned, he was no longer able to carry out heavier duties. He therefore had to apply for a job in a different department, which affected his earnings. At home his personal injury affects his ability to perform more physical activities, such as gardening.
We were instructed to pursue an injury claim on behalf of Mr Anderson against his employer. He felt that they were negligent as the floor had not been maintained to a safe standard and there were no warnings or barriers in place to alert members of staff to the hazard.
An initial offer made by the defendants was rejected, as it did not reflect the extent of the injuries and losses our client suffered. We entered into negotiations with them and eventually secured damages in the amount of £23,500 on Mr Anderson’s behalf. This sum took into account his injuries, his loss of earnings, costs he incurred and his disadvantage with regard to future work.
