At the time his personal injury occurred, our client was carrying out some road repair work with his colleagues. The area they were to work on had been marked out by someone else prior to their arrival and a risk assessment should have been carried out at the same time.
Whilst using a wheelbarrow at the side of the road our client’s foot went down into an open manhole that he was not made aware of. He fell and badly injured his leg, so his colleagues assisted him and called for an ambulance to take him to hospital.
His leg was in plaster for 18 weeks and was unable to attend work for a number of months. He suffered a loss of earnings as a result and his life was adversely affected in general due to his lack of mobility and care requirements during his recovery.
Our client felt that his accident could have been prevented, as the manhole was in an unsafe condition and presented a hazard. He instructed our specialist lawyers to assist him in making a personal injury claim against the utility company responsible for the manhole.
Initially the other side refused to negotiate a compensation settlement, so we began court proceedings. We were able to secure £16,500 in damages before the case went to trial however, on the claimant’s behalf.
