We recently acted in a personal injury claim on behalf of a woman who fell from a boat during a pleasure cruise. She received compensation in respect of her injuries.
At the time of her accident our client was attending a Christmas party with work colleagues, on board a pleasure cruiser. She was up on deck and had been on the dance floor with a friend, when she moved to the edge of the boat to sit down on the seats provided.
Unfortunately, the top bar of a section of the guard rail had not been put into place. It had been left in a raised position as it would be for passengers to disembark, even though the boat was in motion out on the water. Therefore, when she went to lean back against the railings, she fell overboard.
Our client contracted a blood infection because of her fall into the water and had to be treated in hospital. She also developed post traumatic stress disorder and required counselling.
The claimant felt that her accident would not have occurred if the correct health and safety procedures were followed and the rail was in the correct position. She therefore instructed our specialist lawyers to pursue an injury claim on her behalf.
The boat company denied that they were responsible, so we pursued the case to court. We obtained statements from witnesses to the accident and also evidence of our client’s injuries. The Judge agreed with our evidence and found in favour of our client. She was awarded damages for her injuries and the loss of earnings she incurred through her time off work.
