Compensation Claim for Employee Injured in Accident at Work

 

Our lawyers recently acted for a man whose fingers were damaged in a workplace accident, when they became trapped between some kerb stones. They were successful in recovering compensation for his injuries.

Manual Handling

At the time of his accident, the claimant was moving a kerb stone from one pallet onto an adjacent one, which already held several kerb stones.

There were no manual handling procedures in place, or specific instructions on how the job should be carried out. Also, as the claimant’s gloves had become wet and difficult to use, he had taken them off.

The kerb stone slipped from his grasp, bounced off the pallet and caused three of his fingers to become trapped between it and another kerb stone.

Employer at Fault

As the claimant was working in a confined space his employer was found to have breached Workplace Regulation 10 (1). It was also found they did not have sufficient manual handling procedures or suitable protective gloves.

It was held that his employer was primarily responsible for what happened and he was awarded damages.
