A man who was seriously injured in an accident at work received compensation recently, in an injury claim handled on his behalf by our expert personal injury lawyers.
Our client was asked by his employer to jump-start a JCB, as it was old and defective and could only be started this way. A colleague had used the vehicle earlier that day but did not return the gear lever to neutral when he turned it off, instead leaving it in reverse gear. As our client attached the leads to the battery and the vehicle activated, the JCB moved and his legs were pulled underneath one of the wheels.
Another employee rushed to help and was able to pull our client free. The vehicle was stopped and an ambulance was called to the scene. Both of our client’s hips were fractured and he underwent surgery to repair the damage, followed by rehabilitation. He was unable to move around without a wheelchair or crutches for some time during his recovery and required a lot of care and assistance from family members. He later required a further operation to replace one hip joint altogether, which will mean more surgery later in life as replacement joints have a limited life span.
The injuries left our client with ongoing pain and physical limitations. He is no longer fit for certain types of manual work, other strenuous activities or active hobbies.

This sum took into account the pain caused by our client’s injuries, his loss of past and future earnings, the costs of care, travel and treatment and a sum in respect of government benefits to be repaid.
