Slip in Car Park Caused by Failure to Grit

Fall at Work

The claimant was walking between her own car and the car next to it in the school car park, when she slipped on some untreated ice and snow. There had been severe weather conditions over the previous few days and, although grit had been laid in some parts of the car park, the areas between the cars were left untreated.

She fell and suffered injuries to her back and arms as a result of this accident at work.

Personal Injury Claim

No evidence was provided by the defendant that gritting between the cars would not be practical due to costs, and the caretaker stated that it would have only taken 10 minutes for him to perform the task if he was instructed to do it.

The Judge therefore concluded that the claimant’s employer had not taken sufficient steps to remove the hazard and found in favour of the injured party.
