Successful Injury Claim for Trip on Manhole Cover

When a council employee suffered an injury after tripping over a manhole cover on a housing development, our personal injury lawyers assisted him in making a compensation claim.

At the time of his accident, the claimant was visiting a new housing development in the course of his work as a refuse collector. Some road surfacing work was being carried out and the manhole covers in the road had been raised by around 1.5in.

This posed an obvious hazard, so the contractors had created small ramps of sand and cement around the covers to remedy the problem. Unfortunately, over the course of several months this had begun to crumble away, leaving a lip at the top of one of the covers.

As the claimant was pulling some bins along, his heel caught on the lip and he fell, suffering a personal injury.

Compensation Claim

Our lawyers were instructed to assist the injured man in making a claim for this tripping accident.

The case proceeded to Court and the Judge felt that, although the lip itself was only 22mm, the entire defect was 1.5in and the sand and cement had not been applied securely, so the contractors were at fault.
