We recently assisted a man who suffered a cycling accident on his way to work when he was hit by a car. Our specialist personal injury lawyers pursued a claim against the driver of the car and we recovered £70,000 compensation on his behalf.
Our client was cycling along a main road when his road accident occurred. There was a side road to his left and, although it was separated from the main road by give way markings, the driver of the car pulled out across his path to make a right turn and collided with him.
The driver should have noticed our client, as he was wearing high visibility clothing and he had bicycle lights displayed front and back. His view of the road was also unobstructed and the area was well lit.
After the accident our client was in a huge amount of pain and he lost consciousness. His knee was very badly fractured and he was taken to hospital by ambulance, where he underwent a lengthy operation to repair the damage. There were also less serious injuries to his head, elbow and thumb.
Unfortunately our client’s leg injury did not heal well and he required further operations. He then had to spend time in a full length cast, using crutches, and it was difficult for him to do anything without assistance from his family. During his long and painful recovery he was unable to work as normal, had difficulty sleeping and could not enjoy his other usual activities, such as sports, gardening and DIY.
Although he was eventually able to return to his previous job role, he was left with scarring and permanent problems with his knee and will likely require a knee replacement in the future.
The injured cyclist felt the driver of the car was negligent and he appointed our expert lawyers to assist him in making a personal injury claim.
Initially the driver’s insurance company denied liability and it was necessary for us to commence court proceedings. They then put forward an offer of compensation, however we advised our client to reject this as it did not reflect the extent of his injuries and losses. We were subsequently able to negotiate an increased offer of damages in the sum of £70,000. This took into account the pain and suffering caused by the injury and also our client’s loss of earnings and injury-related expenses.
