Our lawyers recently handled a personal injury claim on behalf of a cyclist involved in an accident caused by a hazard in the road.
Whilst cycling along a road, the front wheel of our client’s bicycle struck a sunken fire hydrant and he was thrown from his bicycle to the ground.
He suffered injuries to his face, head, neck and shoulder as a result of this cycle accident and required medical treatment, including physiotherapy.
The claimant instructed our specialist personal injury lawyers to assist him in making a compensation claim. The local authority initially refused to admit responsibility and negotiate a settlement, so the case was pursued to court.
Evidence was provided that the defect was hazardous to cyclists and also that it was not repaired until 7 months after the accident, indicating that the system of six-monthly checks was not working effectively.
The Judge accepted that the hydrant was dangerous under section 41 of the Highways Act and found in favour of our client. He was awarded damages in respect of his injuries and related expenses.
