Mesothelioma Compensation for Widow of Former Joiner

3rd February 2010

A former joiner developed the asbestos-related disease, mesothelioma, due to asbestos exposure throughout his working life. He sadly died as a result of this illness and our specialist industrial disease lawyers recovered compensation on behalf of his widow.

Exposed to Asbestos

Our client, a man in his 60s, was employed as a joiner on construction sites and at power stations. He worked with and around asbestos materials, including asbestolux panels, which he would have to saw and fit to buildings, and asbestos lagging around boilers and pipes. He was not provided with protective equipment or warned of the dangers of inhaling asbestos fibres.

He began to experience shortness of breath, persistent coughing and pain in his chest and side. Tests carried out at hospital confirmed he was suffering from mesothelioma, a deadly form of lung cancer caused by the inhalation of asbestos fibres. Previously a very active man our client became progressively more incapacitated and was unable to do anything physical, such as driving or DIY, and he could no longer enjoy his retirement. He had to undergo painful surgical procedures, radiotherapy and chemotherapy in an attempt to relieve the symptoms and slow the progression of this debilitating disease.

Industrial Disease Claim Against Former Employers

The claimant appointed our expert personal injury solicitors to assist him in recovering compensation and we pursued a claim against his former employers.

We were able to obtain an interim payment during his lifetime, however he unfortunately passed away before the case could be concluded. We recovered damages on behalf of his widow in respect of the pain, suffering and loss of life expectancy her husband endured, the costs of care he received after his diagnosis, the loss of services he previously provided and the loss of his pension income. An amount of bereavement damages was also included. The total compensation recovered was in excess of £250,000.
