A delivery man was injured at work due to a lack of safety at a pub. Our expert personal injury lawyers secured compensation on his behalf.
Our client was delivering some beer to a working men’s club. He had never used their cellar before and a steward showed him the way.
As he attempted to open the cellar hatch he did not see the metal bars supporting it, as the area was not properly lit. One of the bars was accidentally dislodged and it fell, striking the client in the face and causing him to suffer a personal injury.
The steward gave our client no warning about the hatch or the lack of adequate lighting, even though he was unfamiliar with the premises.
Our lawyers handled a compensation claim on behalf of the injured man and the case proceeded to court.
It was held that the working men’s club were in breach of the Workplace Regulations as, if it was possible to dislodge the bar inadvertently, then it was not sufficiently safe. The regulations state that upward opening doors should be fitted with some form of device or mechanism, preventing them from falling back in such a way that they are likely to cause an injury.
The claimant was awarded damages in respect of the injuries he sustained.
