We recently acted for a man who suffered an acoustic shock injury at work due to faulty equipment. He suffered injuries to his head and ear and was left with hearing loss and tinnitus, so we secured personal injury compensation on his behalf.
Our client was a civilian employee of the Ministry of Defence and his work involved the maintenance of fire safety equipment. He was recharging a fire extinguisher using the kit provided, which includes a pressurised air cylinder. Unfortunately part of the kit failed and the hose from the cylinder exploded.
The hose was next to our client’s ear when it burst and it caused him to suffer bruising and swelling to the inside of his ear and side of his head. He felt nauseas and dizzy and could not hear well at all on the injured side, so he consulted his GP for advice. He was diagnosed with tinnitus and hearing loss. These conditions are permanent and he will require a hearing aid.
The injured employee felt that his accident could have been avoided if the equipment he was provided with was in a safe condition. He therefore appointed our specialist personal injury lawyers to pursue a compensation claim on his behalf.
We put forward evidence that the kit had not been serviced and our client could not do this himself as he was not trained to. His employer therefore failed to take sufficient health and safety measures that may have prevented the equipment failure.
The MoD admitted liability and we secured £10,000 in damages for our client. This sum was in respect of the personal injury he sustained and also his related financial losses, such as his loss of earnings, the costs of medical treatment and equipment and travel expenses for hospital visits.
