Accident at Work Claim for Injured Employee

Workplace Accident

In the course of her work, the claimant had to use a large, outdoor rubbish bin. Prior to her accident, this had been replaced with a new bin with a lockable lid. It was kept inside a metal cage and the lid was heavy. The lid would not fix into a position where it would stay open, and the roof of the cage prevented it from being opened fully, so it had to be held whilst rubbish was put inside.

The claimant struggled to use the bin, as its size meant she had to hold the lid at above head height. Whilst trying to put in some bags of rubbish, the lid sprung out of her hand and injured her wrist.

Personal Injury Claim

Our client suffered ligament damage and was treated at hospital. She had to take time off work and required assistance from family members with everyday tasks. She underwent physiotherapy, steroid injections and eventually an operation, however has been left with permanent weakness, numbness and some occasional pain, restricting her ability to carry out certain tasks at work and at home.

The claimant felt that her employer was responsible for the accident, as there was a lack of health and safety measures in place. She later found that another centre which was run/operated by her employers had been provided with a set of hooks to hold the bin open.
