An employee who sustained serious injuries to his hand due to a dangerous piece of machinery made a compensation claim recently, with help from our expert personal injury lawyers.
At the time of his accident at work, our client was training a colleague in the operation of a machine. Large bags come off the machine along a conveyor belt and onto a set of rollers, ready to be unloaded. Unfortunately however, there was a gap around an inch wide between the conveyor and the rollers and this was not covered with a guard or any other safety feature.
The claimant’s hand was pulled into the gap up to his knuckles and he sustained crush injuries and friction burns to his hand and fingers. Hospital treatment was necessary, including surgery to carry out a skin graft, and our client suffered long-term effects of his injury.
He had to take time off from work and was unable to carry out household tasks or participate in his usual leisure activities during his recovery.
Our client held his employer responsible for the accident, as the machine was not in a safe condition for employees to use. Another member of staff also suffered a personal injury in a similar way, and eventually a cage was placed over the gap to prevent similar accidents from occurring in the future.
The claimant instructed our lawyers, who specialise in factory accidents and other workplace accidents, to pursue a personal injury claim on his behalf. His employers were found to be liable and he received a settlement of £11,500 in damages.
If you have been involved in an accident at work due to a lack of health and safety measures, you may be entitled to make a claim for compensation.
