In a recent case, our specialist personal injury lawyers recovered compensation for a man who suffered a serious leg injury in an accident at work.
Our client was turning over a large metal plate using an overhead crane at the time of his workplace accident. The plate, which weighed around one and a half tonnes, was hanging from a pendant held by a crane and so it was able to swing freely.
The area in which he was working was cramped and it was difficult to keep the plate controlled and steady whilst turning it over. He had also not received any specific training on the task or seen a risk assessment for it.
In the course of the manoeuvre the plate swung towards our client and struck his leg forcefully, knocking him to the ground. His leg was badly broken and he had to undergo surgery to repair the damage, followed by a lengthy recovery period including time using a wheelchair and crutches. Although he was eventually able to return to work, he has been left with long-term problems with his leg and permanent scarring.
The injured worker appointed our expert lawyers, who have extensive experience in cases involving injuries at work, to assist him in making a personal injury claim against his employer. He felt that a safer method of turning the plate could have prevented his accident.
We began a case against his employer and, although they made an initial offer of compensation this did not reflect the extent of our client’s injuries. We therefore rejected this offer and began court proceedings, however it was possible to negotiate a suitable settlement before the case went to trial and our client was awarded a total of £17,500 in damages.
