Successful Personal Injury Claim for Shot Blasting Accident

20th October 2009

In a recent personal injury case, our lawyers assisted a man left with scarring from a leg injury sustained in a shot blasting accident at work in recovering compensation.

Injured at Work

Our client was working in a dark, shot blasting area at the time of his workplace accident. A colleague entered the room through a door marked ‘No Unauthorised Access’ and allowed light in, causing a sudden distraction. This caused our client to move the shot blaster and it pointed at his leg, causing severe damage to the skin.

In addition to the distraction caused by his colleague, the claimant was not provided with sufficient personal protective equipment, which may have prevented his leg injury. He was also not fully trained.

Claim Against Negligent Employer

The injured worker felt that his employer was responsible for his injury, as they did not have sufficient health and safety measures in place. If there was a safer system of work and better protective equipment the incident could have been avoided.

He instructed our specialist personal injury lawyers to pursue a compensation claim on his behalf. The matter was taken to court and the Judge found that his employer was in breach of the Management of Health and Safety at Work Regulations. Compensation was awarded to our client for his injuries and losses.
