Our lawyers recently assisted a young woman injured in a holiday accident whilst playing water polo at her hotel. They recovered compensation on her behalf, in respect of the personal injury she suffered.
At the time of her accident, the claimant was on a package holiday in Greece. She was playing water polo with some other guests in the hotel pool, when the ball went out of play.
She went to retrieve it, walking along one of three walkways around the pool. These had a smooth marble surface and, although two of them were covered with matting, the one the claimant used was not.
She slipped and fell due to the unsuitable surface and suffered an injury, for which she required treatment including physiotherapy.
The claimant and her family felt that the tour operator was responsible for her accident, as they failed to ensure that safe facilities were provided for their customers.
The Judge found that the walkway in question was a high-risk area, because it was behind the goal posts used in water polo games, so matting should have been put in place to prevent accidents when people with wet feet walked upon it. It was foreseeable that a guest may walk across that area to fetch a ball during a game.
As the holiday company was found to have been negligent, the injured claimant was awarded damages.
