The widow of a man who tragically died, due to lung cancer caused by exposure to asbestos at work, received compensation recently, in an industrial disease claim handled by our specialist personal injury lawyers.
Our client was employed as a fitter in the steel industry for many years. During this time he had to repair, replace and maintain brake linings that contained asbestos. He also worked on pipes and furnaces covered with asbestos lagging and worked alongside laggers who were mixing and applying new asbestos lagging. In addition there was asbestos dust present in the general environment at his workplace and this would contaminate his clothes.
After he retired he began to suffer problems with his health and tests showed that he was suffering from lung cancer. Although he underwent some treatment initially, our client’s illness was terminal and he required increasing levels of care as his condition deteriorated and he became progressively more incapacitated.
He appointed our lawyers to assist him in making a personal injury claim against his former employers. He felt that they were responsible for his illness, as they failed to warn him about the dangers of working with asbestos and did not provide any protection against inhaling the harmful fibres.
They initially denied that he was exposed to sufficient levels of asbestos to cause the lung cancer through his employment with them, or that they were liable. We obtained medical evidence, detailed information and witness statements from our client’s former colleagues and issued court proceedings. Our client sadly died before the claim was settled, however we were able to secure over £140,000 in damages for his widow.
