Our expert industrial disease lawyers recently acted in a compensation claim on behalf of a woman suffering from mesothelioma, who was exposed to asbestos as a child.
When she was a young child, our client lived with family near to an asbestos factory. The school she attended was directly opposite the factory and her relatives also ran a social club that was in close proximity to it.
Asbestos dust poured out from the factory in sufficient quantities that it was often visible in the air, and it would settle as a thick layer of white dust on the premises of the school and social club and in the surrounding streets.
She did not have any exposure to asbestos later in life or through her employment.
A chest x-ray showed the presence of an abnormality on our client’s lung and a subsequent biopsy sadly confirmed that she was suffering from mesothelioma, a fatal form of cancer associated with asbestos exposure.
Mesothelioma is a very debilitating disease and can advance rapidly. Our client had to retire earlier than planned and she underwent chemotherapy treatment to try to slow the progression of her illness.
The claimant appointed our specialist personal injury lawyers to act on her behalf in a compensation claim, as the company that owned the factory was responsible for allowing the hazardous asbestos dust to contaminate public areas.
The company was part of the Turner and Newall Group, which had already gone into administration. A trust was set up by the administrators of the company to provide some compensation to victims, so we applied to the trust on our client’s behalf. Unfortunately however the trust fund does not pay the full amount of damages that a claim is worth, only a percentage of the value.
We were able to act quickly to secure as much compensation as possible for our client and the claim was settled within her life time. Cases such as this highlight the importance of having an experienced firm of solicitors acting on your behalf. Our client received 100% of the compensation we recovered for her from the T&N Asbestos Trust.
If you or a member of your family is suffering from mesothelioma, or any other asbestos-related illness, a compensation claim may be possible.
