In a recent case handled by our expert industrial disease lawyers, a retired rail worker diagnosed with mesothelioma received compensation.
Throughout his working life our client was employed by British Rail, which became Midland Mainline following privatisation. He held various roles, working as a Passed Cleaner, Fireman and Second Man, then eventually as a Train Driver for over 30 years.
He was exposed to asbestos on a regular basis, as it was used for insulation around the boilers, pipes and fire boxes of the steam engines. Often this lagging was not well maintained and it would become frayed, dry and flaky. Large amounts of dust would be released into the atmosphere when the trains were operating and the claimant was not protected from inhaling the asbestos dust.
At a time when he should have been enjoying his retirement, our client was diagnosed with mesothelioma, a deadly form of lung cancer caused by exposure to asbestos. Previously active and in good health, he began to suffer breathlessness and aching in his chest. The diagnosis was confirmed by a biopsy and some radiotherapy was carried out at hospital initially to help control his symptoms.
