A youth riding a goped caused injuries to a firefighter and his wife, who were driving a pony and trap. Our specialist lawyers were able to recover £82,000 compensation on their behalf.
The claimant was driving his pony and trap at the time of the road accident, with his wife as a passenger. They were heading along a country lane when a 14 year old approached from the opposite direction on a goped.
The youth made a u-turn directly in front of the horse’s face and revved the engine deliberately. This frightened the horse and it bolted, causing the claimant and his wife to be thrown from the trap.
Because no insurance policy was in force to cover the goped, and the defendant was a minor, the personal injury claim was pursued via the Motor Insurers Bureau (MIB).
At trial, accounts of the incident were heard and the claimant’s evidence was preferred to the defendant’s. The case was settled and an award of damages was made.
